Terms of Service

1. Parties and Scope

These Terms of Service ("Terms") govern your use of the RAWCAST platform and website ("Service"), operated by Artide Innova SRL, Via Rosina Sessa 16, 84128 Salerno (SA), Italy, P.IVA 06198200658 ("we", "us", "RAWCAST").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

RAWCAST is a real-time video encoding platform that provides low-latency streaming infrastructure via WHEP and SRT protocols. The Service is currently in beta and may be subject to changes, interruptions, or discontinuation without prior notice.

3. Beta Program

Access to the RAWCAST beta is provided at our discretion. Beta users acknowledge that:

  • The Service may contain bugs, errors, or incomplete features.
  • We make no guarantees of uptime, performance, or availability during the beta period.
  • We may modify, suspend, or terminate beta access at any time.
  • Feedback provided during the beta may be used to improve the Service without compensation.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to stream illegal content.
  • Attempt to gain unauthorized access to the Service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell or redistribute the Service without written authorization.

5. Intellectual Property

The RAWCAST name, logo, brand identity, software, and all related intellectual property are owned by Artide Innova SRL. Nothing in these Terms grants you any rights to use our trademarks or branding without prior written consent.

You retain all rights to your own content streamed through the Service. We do not claim ownership of your video content.

6. Limitation of Liability

To the maximum extent permitted by applicable law, RAWCAST and Artide Innova SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or EUR 100, whichever is greater.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

8. Data Protection

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with the GDPR and applicable Italian law.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. Upon termination, your right to use the Service ceases immediately.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Salerno, Italy, without prejudice to your rights under mandatory consumer protection laws.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
